Terms of Service

These Terms govern your use of BuyMyTune as a buyer, artist, or visitor. By using the platform you agree to these Terms. If you do not agree, do not use the platform.

1. Who we are

BuyMyTune is a UK-based independent music marketplace. References to "we", "us", or "BuyMyTune" in these Terms mean the operating entity above.

2. Fan purchase terms

UK consumer law (Consumer Contracts Regulations 2013) provides a 14-day cooling-off period but includes an exception for digital content that has been accessed with the consumer's consent. The "no refunds once downloaded" position must be clearly disclosed pre-checkout to be enforceable.

When you purchase a release on BuyMyTune, you receive a non-exclusive, non-transferable licence to download and use the audio files for personal, non-commercial enjoyment.

Because digital music downloads are delivered immediately and are non-returnable once accessed, we are not able to offer refunds after a download has been initiated, except where required by law or where there is a demonstrable technical fault with the delivered files.

Purchases are made in GBP. UK VAT is applied at the prevailing rate where required. The total amount you pay at checkout (including VAT) is shown before you confirm payment.

3. Artist selling terms

[NEEDS LEGAL REVIEW] Review the rights representation warranty with a music lawyer. Artists must confirm they control rights. This section must not accidentally imply we verify those rights on their behalf.

To sell on BuyMyTune, you must create an artist account and agree to these Terms. By uploading a release, you represent and warrant that:

  • You own or control all rights necessary to sell the uploaded content;
  • The content does not infringe any third-party copyright, trade mark, or other intellectual property right;
  • The content does not violate our Acceptable Use Policy;
  • You are at least 18 years old or have the consent of a parent or guardian.

You retain ownership of your music. By uploading, you grant BuyMyTune a non-exclusive licence to store, deliver, and display your content solely for the purpose of operating the platform.

4. Payout terms

[NEEDS LEGAL REVIEW] Confirm payout holding period duration, minimum threshold (if any), and bank transfer SLA with the operations team before publishing. Specify the legal basis for holding funds.

Artist earnings are accumulated in a payout balance. Funds are held for a short period following each sale to allow for potential chargebacks, then become available for withdrawal. You can request a bank transfer from the artist dashboard at any time.

A 15% platform fee helps run BuyMyTune: secure file hosting, signed downloads, buyer support, artist tools, payout records, and ongoing development. The current platform fee rate and an example fee breakdown are published on our How Money Works page. PayPal transaction fees are separate and deducted by PayPal before funds reach BuyMyTune. We will provide reasonable notice of any change to platform fee rates.

In the event of a successful PayPal chargeback, the corresponding amount may be reversed from your payout balance. We will notify you before any such reversal.

5. Prohibited use

You must not use BuyMyTune to:

  • Upload content you do not have the right to sell;
  • Sell, resell, or redistribute purchased downloads to third parties;
  • Use the platform for any unlawful purpose;
  • Attempt to circumvent technical measures protecting files;
  • Engage in any conduct listed in our Acceptable Use Policy.

If you come across content that breaks these rules, use the Report button on any release or artist page. Reports are confidential — we never tell the uploader who reported them. Content that attracts multiple reports may be automatically taken offline pending review.

6. Chargebacks and disputes

Payment disputes are handled through PayPal's standard dispute resolution process. If a buyer raises a dispute, we will cooperate with PayPal's investigation. The outcome of PayPal's process is binding on both parties.

Artists with excessive dispute rates may have their accounts reviewed and may be subject to temporary fund holds while disputes are resolved.

7. Service availability

We aim to keep BuyMyTune available and functioning at all times, but we do not guarantee uninterrupted access. Planned maintenance will be communicated where possible. We are not liable for losses arising from temporary unavailability.

8. Account termination

You may close your account at any time by contacting us. Artists must ensure all outstanding payout balances are withdrawn before requesting account closure.

We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy, with or without prior notice depending on the severity of the breach. We will use reasonable efforts to notify you and provide an opportunity to remedy the breach where appropriate.

Upon termination, your published releases will be removed. Buyers who have already purchased your releases retain their download entitlements.

9. Limitation of liability

To the maximum extent permitted by applicable law, BuyMyTune is not liable for indirect, consequential, or incidental damages arising from your use of the platform. Our total liability in connection with any claim arising from these Terms shall not exceed the amount paid by you to BuyMyTune in the twelve months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by a prominent notice on the platform. Continued use of BuyMyTune after changes take effect constitutes acceptance of the updated Terms.
